Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services offered by us for NZLeads / FreshLeads (the “Service”). By creating an account, paying for a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The service

NZLeads provides tools to browse publicly available New Zealand business registration information (including NZBN-sourced data made available through official channels), claim exclusive access to selected leads within the platform, and (where offered) purchase credits or optional fulfilment such as printed letters. Features may change over time; we will try to give reasonable notice of material changes that affect billing or core access.

3. Accounts & eligibility

You must provide accurate registration information and keep your login credentials secure. You are responsible for activity under your account. The Service is intended for legitimate commercial outreach by individuals and businesses operating in good faith. You must not use the Service if you are barred from doing so under applicable law or if your use would violate anti-spam, fair trading, or privacy obligations.

4. Fees, credits & billing

Paid plans, credits, and optional add-ons are billed through our payment provider (Stripe). Prices and included allowances are shown at checkout or in your account. Unless stated otherwise, recurring subscriptions renew according to the billing cycle you select until cancelled. Credit packs and usage rules (including expiry or reset of monthly credits) are described on the site at purchase time.

To the extent permitted by law, fees are non-refundable except where required by law or where we expressly agree in writing. If you believe a charge is in error, contact us promptly at hello@freshleads.co.nz.

5. Free trial

FreshLeads offers a free trial of 10 Smart Mailer letters (personalised letter + QR code) to new users.

What the trial includes:

  • 10 Smart Mailer letters sent on your behalf at no charge
  • Full access to the lead browsing dashboard
  • Access to the Smart Mailer AI assistant setup

How the trial works:

  • When you sign up for the trial, your payment card is saved securely via Stripe but not charged
  • Your trial ends when either 10 Smart Mailer letters have been sent, or 30 days have passed — whichever comes first
  • At the end of your trial, your subscription automatically activates at NZ$59/month
  • You will receive a reminder email 3 days before your first charge, stating the exact amount and date

Cancellation:

  • You may cancel at any time before your trial ends with no charge
  • To cancel, visit Settings & billing in your dashboard
  • If you cancel after your subscription has activated, cancellation takes effect at the end of that billing period

Letters after the trial:

  • Letter only: NZ$4 each
  • Letter + Fridge Magnet: NZ$6.50 each
  • Letter + Smart Mailer: NZ$6.50 each

6. Business directory data (NZBN)

Information about third-party businesses may be sourced from the New Zealand Business Number (NZBN) public register and similar official sources. That data is not owned by you. Your use of such data must comply with applicable law, the NZBN / MBIE terms of use (where they apply to you), and our Privacy Policy. The Service does not provide legal or compliance advice; you are responsible for your own marketing and outreach practices.

7. Acceptable use

You agree not to:

  • misuse the Service, attempt unauthorised access, or interfere with other users;
  • use claimed information to harass, threaten, or mislead recipients;
  • scrape, resell, or systematically redistribute our platform data except as permitted;
  • send unsolicited electronic messages in breach of the Unsolicited Electronic Messages Act 2007 or similar laws;
  • upload unlawful, defamatory, or infringing content.

8. Letters & mail fulfilment

Where letter printing or postage is offered, you are responsible for the accuracy and legality of content you supply (including merge fields). We act as a fulfilment facilitator only and do not endorse message content. Delivery timelines depend on postal operators and are not guaranteed.

9. Intellectual property

We retain all rights in the Service, branding, and software. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal commercial purposes. You must not copy, reverse engineer, or create derivative works from the Service except where permitted by law.

10. Disclaimers & liability

The Service is provided “as is” and “as available.” To the maximum extent permitted by New Zealand law, we disclaim implied warranties. Nothing in these Terms limits rights that cannot legally be limited (including rights under the Consumer Guarantees Act 1993 where you qualify as a “consumer”).

To the extent permitted by law, our total aggregate liability arising from these Terms or the Service is limited to the amount you paid us in the three months before the claim (or, if greater fairness requires, the remedies set by statute).

11. Suspension & termination

We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or if required by law. You may stop using the Service at any time; cancelling a subscription follows Stripe and in-product flows where applicable.

12. Governing law

These Terms are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the courts of New Zealand.
